1. About these Terms

These Terms of Service ("Terms") are an agreement between you and Matchstick Sport (Pty) Ltd ("we", "us" or "our") governing your use of Matchstick Hockey Team Management (the "App").

By downloading, installing or using the App, you agree to these Terms. If you do not agree to these Terms, you must not use the App.

Our Privacy Policy explains how personal information is handled in connection with the App and forms part of these Terms.

2. Who may use the App

The App is intended for coaches, managers and other team officials.

You must be at least 18 years old and legally capable of entering into these Terms.

If you use the App on behalf of a club, school, team or other organisation, you confirm that you are authorised to do so and to accept these Terms on its behalf where applicable.

3. Licence to use the App

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable and revocable licence to use the App on devices that you own or control for lawful team-management purposes.

The App is licensed, not sold, to you.

You must not:

• copy, modify, adapt or create derivative works of the App;

• reverse engineer, decompile or disassemble the App, except to the extent that applicable law expressly permits you to do so;

• sell, rent, lease, sublicense, redistribute or otherwise make the App available to another person as a separate product or service;

• use the App for unlawful purposes or to harass, threaten, defame or harm another person;

• interfere with or attempt to compromise the security, integrity or operation of the App; or

• remove or alter copyright, trademark or other proprietary notices contained in the App.

All intellectual property rights in the App, including its software, design, branding, graphics and other materials, remain with Matchstick Sport (Pty) Ltd or our licensors.

4. Your information and your responsibilities

Information that you enter into the App, including player information, opponents, matches and squad lineups, is stored locally on your device during normal operation of the App. We do not maintain a server-side copy of this information.

You are responsible for:

• ensuring that the information you enter is accurate and lawful;

• having the necessary permission or other lawful basis to enter information about other people;

• obtaining any consent or authorisation required by law when entering information about children;

• ensuring that you have the necessary rights to use photographs that you add to the App;

• maintaining appropriate security for your device; and

• deciding what information you export or share from the App and with whom you share it.

You must not use the App to store or share content that is unlawful, infringes another person's rights, or is abusive, threatening, discriminatory or otherwise unlawful.

5. Backups and data loss

IMPORTANT: Because information entered into the App is stored locally on your device, it may be permanently lost if you delete the App, lose, reset, replace or damage your device, or if the device or its storage fails. We do not maintain a server-side backup of your team information and generally cannot recover information that has been lost from your device.

You are responsible for maintaining appropriate backups of your device using the backup facilities available on your device or operating system. We do not guarantee that your device or operating system will back up or restore all information created by the App.

6. Third-party services

The App depends on third-party services and technologies, including your device's operating system, the app store from which you obtained the App, device permissions, sharing applications and Sentry for technical diagnostics.

Your use of third-party services may be subject to their own terms and privacy policies. We are not responsible for services that are operated independently by third parties.

You are responsible for complying with the applicable terms of the app store and other third-party services that you choose to use with the App.

7. Availability and changes to the App

We aim to keep the App reliable and functional, but we do not guarantee that the App will always be available, uninterrupted or error-free.

We may update, modify, suspend or discontinue features of the App from time to time, including where necessary for security, technical, legal or business reasons.

Where reasonably practicable, we will provide notice of material changes or discontinuation.

Because the App currently stores team information locally on your device and does not provide a general-purpose export or backup of its underlying data, you should maintain appropriate backups of your device if you wish to reduce the risk of losing that information.

8. Fees

The App is currently provided free of charge.

We may introduce paid features, subscriptions or other charges in the future. Where applicable, we will provide the relevant pricing and terms before you are charged, and these Terms will be updated as necessary.

9. Disclaimer

IMPORTANT: To the extent permitted by applicable law, the App is provided on an "as is" and "as available" basis. We do not guarantee that the App will meet all of your requirements, that it will be available at all times, that it will be free from errors or interruptions, that information created or displayed by the App will always be accurate or complete, or that the App will be suitable for every particular match, competition, team or use case.

The App is a team-management tool and is not a substitute for the official rules, regulations, requirements or decisions of a governing body, competition, tournament, club, school or other organisation. You are responsible for decisions you make using information provided by the App, including decisions relating to player selection, lineups, substitutions, match management and competition requirements.

Nothing in these Terms excludes, restricts or modifies any right or remedy that you have under the Consumer Protection Act 68 of 2008 or any other applicable law that cannot lawfully be excluded, restricted or modified.

10. Limitation of liability

IMPORTANT: To the maximum extent permitted by applicable law, Matchstick Sport (Pty) Ltd will not be liable for any indirect, incidental, special or consequential loss arising from or relating to your use of, or inability to use, the App.

This includes, to the extent permitted by law, loss of data, loss of profits, loss of revenue, loss of business opportunity, loss of goodwill or business interruption. Because team information is stored locally on your device, we are not responsible for loss of that information resulting from deletion, device failure, loss, theft, reset, replacement, operating-system failure or failure to maintain appropriate backups.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability that cannot lawfully be excluded for death or personal injury, fraud, gross negligence, intentional misconduct or any other matter for which liability cannot legally be limited.

11. Suspension and termination

You may stop using the App at any time by deleting it from your device.

We may suspend or terminate your licence to use the App if you materially breach these Terms, misuse the App, interfere with its operation or security, or where suspension or termination is required by law.

Termination of your licence does not affect provisions that are intended by their nature to continue after termination, including provisions relating to intellectual property, disclaimers, limitations of liability and governing law.

12. Changes to these Terms

We may update these Terms from time to time.

The "Last updated" date at the beginning of these Terms indicates when they were most recently updated.

Where we make material changes, we will provide reasonable notice through the App, our website or another appropriate method.

Where required by applicable law, we will obtain any required agreement to the updated Terms.

Otherwise, continued use of the App after the updated Terms take effect constitutes acceptance of the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa.

If you have a complaint or dispute, we encourage you to contact us first so that we can try to resolve the matter informally.

Nothing in these Terms prevents you from exercising any rights or pursuing any remedies available to you under applicable South African law, including approaching an applicable consumer body, regulator, tribunal or court.

Where a dispute is required or permitted to be determined by a South African court, the appropriate South African courts will have jurisdiction in accordance with applicable law.

14. General

These Terms, together with the Privacy Policy and any other terms expressly incorporated into them, constitute the agreement between you and Matchstick Sport (Pty) Ltd concerning your use of the App.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to apply.

If we do not immediately enforce a provision or exercise a right under these Terms, that does not constitute a waiver of that provision or right.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where permitted by applicable law.
